Terms of sale
This is an English translation provided for convenience. The Polish version is the legally binding one. If anything is unclear, write to sklep@clayzo.pl.
These Terms set out the rules for using the clayzo.pl online store and for concluding contracts of sale for ceramic tools made to the Customer's individual order.
§1. Seller
- The seller and owner of the store is Piotr Włodarczyk, VAT ID PL 8381704913, ul. Pasteura 6a/33, Warsaw, Poland.
- Contact: sklep@clayzo.pl, +48 602 755 522.
§2. Definitions
- Store — the website at clayzo.pl.
- Customer — a natural person, legal person or organisational unit placing an order.
- Consumer — a Customer who is a natural person entering into a contract not directly related to their business or professional activity, as well as a sole trader with consumer rights.
- Product — a physical ceramic tool (plaster mold, cutter, stamp, roller, letters, tiles, socket and other items in the offer) manufactured with 3D printing based on the configuration chosen by the Customer.
- Configurator — the tool in the Store used to choose the shape, size, texture and other parameters of the Product.
§3. Nature of the products
- All Products are made to order, individually for a given Customer, according to the parameters and personalisation set in the Configurator (size, shape, pattern, wording, material colour). We do not sell from stock.
- We sell exclusively finished, printed and cleaned tools. Digital files (e.g. STL) and model licences are not the subject of the contract.
- Products are made using additive manufacturing. Visible layer lines, slight differences in material shade and dimensional tolerances of up to approx. 0.5 mm are inherent to this technology and do not constitute a defect.
- Molds are intended for casting a plaster mold yourself; plaster, clay and consumables are not included in the order unless the product description states otherwise.
§4. Placing an order
- An order can be placed as a guest or from a user account. First and last name, delivery address, e-mail address and phone number (required by carriers for delivery notice) are mandatory.
- Before confirming the order, the Customer must verify the Product configuration — in particular the dimensions, the wording and the chosen size variant. We fulfil orders in line with the saved configuration.
- Placing and paying for an order is equivalent to concluding a contract of sale for goods made to the Customer's specification.
- We send an order confirmation with a summary to the e-mail address provided.
§5. Prices and payments
- Prices shown in the Store are gross prices in Polish zloty (PLN).
- Payment is made up front through an online payment provider. Production starts once the payment has been credited.
- The delivery cost shown in the cart before checkout is added to the order.
- At the Customer's request we issue an invoice with the details provided.
§6. Fulfilment and delivery
- Standard production time is 2–5 business days; the delivery time of the chosen shipping method is added on top.
- Delivery methods, their costs and the free shipping threshold are described on the Shipping page.
- Delivery is made within Poland unless agreed otherwise.
- For unusual orders (large formats, many variants) the lead time may be longer — we will inform you by e-mail.
§7. No right of withdrawal
- Pursuant to Article 38(3) of the Polish Act of 30 May 2014 on Consumer Rights, the right to withdraw from a distance contract does not apply to contracts where the subject of the performance is a non-prefabricated item produced to the consumer's specification or serving to satisfy their individualised needs.
- All Products in the Store are manufactured only after an order is placed, according to the Customer's individual configuration, and therefore cannot be returned or exchanged under the 14-day withdrawal right.
- The Customer accepts this exclusion by confirming the order. The information about the lack of a withdrawal right is also shown in the order summary.
- The above does not limit the Customer's rights regarding a Product's non-conformity with the contract (complaints) described in §8.
- An order can be cancelled free of charge only before production starts — please contact us as soon as possible at sklep@clayzo.pl. Once printing has started, cancellation is not possible.
§8. Complaints
- The Seller is liable for the Product's conformity with the contract under the rules set out in the Act on Consumer Rights.
- Complaints should be sent to sklep@clayzo.pl, stating the order number, a description of the non-conformity and photos of the Product.
- We handle complaints within 14 days of receiving them.
- If a complaint is accepted, we repair or remake the Product at our cost; if that is impossible or disproportionately expensive, we reduce the price or refund the amount paid.
- Complaints do not cover damage resulting from improper use (including dishwasher cleaning, exposure to temperatures above 50°C, contact with solvents) or the technological characteristics described in §3(3).
- Complaints also do not cover non-conformity resulting from an incorrect configuration provided by the Customer (e.g. a typo in the wording, a size chosen too small).
§9. Account and Customer content
- Creating an account is voluntary and free; it can be deleted at any time.
- The Customer retains the rights to their own content (e.g. uploaded artwork, descriptions) and declares that they hold the necessary rights to it and that it does not infringe third-party rights.
- The Customer grants the Seller a non-exclusive licence to use the submitted content solely to the extent necessary to fulfil the order.
- Providing unlawful content and using the Store in a way that disrupts its operation is prohibited.
§10. Final provisions
- Matters not covered here are governed by Polish law, in particular the Civil Code and the Act on Consumer Rights.
- A Consumer may use out-of-court complaint and redress procedures, including the European Commission's ODR platform.
- The rules for processing personal data are described in the Privacy policy.
- The Seller reserves the right to amend these Terms. Orders placed before an amendment are governed by the Terms in force at the time they were placed.
